RE: The tariff classification of healthcare uniform top from Honduras and Nicaragua.

Dear Ms. Ginn:

In your letter dated October 22, 2007, you requested a classification ruling. Garment specifications were furnished.

The item is a Style 9527 Women’s Healthcare Uniform Top constructed of woven 65% polyester, 35% cotton fabric. The top features a criss cross-style V-neck, short sleeves, safety stitching and a patch pocket below the waist with an “Urbane” logo.

The applicable subheading for the Style 9527 Women’s Healthcare Uniform Top will be 6211.43.0060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Other garments, women’s or girls’: Of man-made fibers, Blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garments, excluded from heading 6206.” The general duty rate will be 16% ad valorem.

Style 9527 falls within textile category 641. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
