RE: The tariff classification of a napkin from China

Dear Ms. Gunduz:

In your letter dated October 12, 2007 you requested a classification ruling.

You submitted a swatch of fabric representing the construction of a napkin (Ref. 0045). The napkin will be made from 53 percent cotton, 32 percent polyester and 15 percent acrylic woven fabric. The napkin will have hemmed edges and will measure 18 x 18 inches.

The applicable subheading for the napkin will be 6302.51.3000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for bed linen, table linen, toilet linen and kitchen linen: other table linen: of cotton: tablecloths and napkins: other: other. The rate of duty will be 5.8 percent ad valorem.

The napkin falls within textile category designation 369. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
