RE: The tariff classification of a handbag from China

Dear Mr. Menard:

In your letter dated October 10, 2007, you requested a tariff classification ruling. The sample which you submitted is being returned as requested.

A style number was not provided for the sample submitted. It is a handbag constructed with an outer surface of polyvinyl chloride (PVC) plastic sheeting material. It is designed and sized to contain the small personal effects that would normally be carried on a daily basis. The interior of the bag has a textile lined compartment with a zippered wall pocket and three slots to hold identification or credit cards. The top of the bag is secured with a zipper. The handbag has a metal chain that can be worn over the shoulder. The front exterior of the bag has an open pocket and a floral appliqué. It measures approximately 6.5” (W) x 4” (L).

The applicable subheading for the handbag will be 4202.22.1500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for handbags, whether or not with shoulder strap, including those without handle, with outer surface of sheeting of plastic. The rate of duty will be 16 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
