RE: The tariff classification of an adult costume from China.

Dear Mr. Fragomeli:

In your letter dated September 19, 2007, you requested a classification ruling. The samples which you submitted are being returned as requested.

The submitted sample, Butterball Costume Set will be imported as follows:

Item 6808847, Size S
Item 6808848, Size M
Item 6808849, Size L

The Butterball costume consists of a long dress-like garment that you describe as a robe, mask, gloves and belt. You indicate that the dress-like garment (robe) is made of woven fabric; however examination reveals that it is made of knit velour 100% polyester fabric. The dress-like garment has a large collar with a mandarin style neckline, long sleeves with an embellishment on each shoulder, and embellishments down the front and a back zipper closure.

The Butterball Costume Set is well made with finished neck, styling and embellishments.

General Rule of Interpretation (GRI) 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale. GRI 3(b) states that the goods “shall be classified as if they consisted of the material or component which gives them their essential character.” In this case, the dress-like garment (robe) imparts the essential character of the set.

       The applicable subheading for Items 6808847,6808848 and 6808849, Butterball Costume Set will be 6104.43.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Women's or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear); knitted or crocheted: Dresses: Of synthetic fibers, Other, Women’s." The rate of duty will be 16% ad valorem. The textile category designation is 636.
