RE: The tariff classification of Bratz TM Fashion Designer Yasmin, Item #370918 from China

Dear Ms. Cooper-Martin:

In your letter dated October 2, 2007, you requested a tariff classification ruling.

The sample submitted, Bratz TM Fashion Designer Yasmin, is identified as item number 370918. The toy set consists of a Bratz Fashion Doll, 16 fashion stencils, 4 fashion papers to be used as fabric, 3 small colored pencils, 1 package of designer beads, 1 package of glitter, 1 glitter glue pen, 1 pair of scissors, and 1 designer sketchbook. The doll measures approximately 81/2 inches in height. The item is designed so that a child can design various outfits for the doll. The item is packaged inside a cardboard box with a window display and is intended as a toy for a child 6 years of age and older.

The applicable subheading for the Bratz TM Fashion Designer Yasmin will be 9503.00.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Tricycles, scooters, pedal cars other toys parts and accessories thereofOther. The rate of duty will be Free.
