RE: The tariff classification of an apron from China.

Dear Ms. Clines:

In your letter dated September 21, 2007, for Intellicam Systems LLC you requested a classification ruling. The sample which you submitted is being returned as requested.

The submitted sample is a gardening apron made of woven 100% cotton fabric. The bib-style apron has an adjustable textile neck and waist strap, a pocket on the bib, one pocket on the right side and two on the left side. The apron also features a pocket with a hook and loop closure that when opened can be used to hold small weeds or kneel on when gardening.

 The applicable subheading for the apron will be 6211.42.0081, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Track suits, ski-suits and swimwear; other garments: Other garments, women’s or girls’: Of cotton: Other." The rate of duty will be 8.1% ad valorem. The textile category designation is 359.
