RE: The tariff classification of induction cooktops from China

Dear Ms. Yoo:

In your letter dated September 20, 2007 you requested a tariff classification ruling. Descriptive literature and an illustration were submitted.

The items you plan to import are described as induction cooktops, Model Numbers HN7413AG and LCE30845. They are designed to be built into cabinets and do not include ovens. These units contain a ceramic glass top plate with a touch pad control system, four cooking elements and a bridge element to evenly heat longer pans and griddles.

These units operate through electromagnetic energy generated by an induction coil that reacts with iron-like metals. The pot absorbs the electromagnetic energy and converts it into heat. The heat is quickly transferred to the food inside the pot. Only the bottom of the pot is heated which guarantees even heating.

The applicable subheading for the induction cooktops will be 8516.60.4080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other cooking stoves, ranges and ovens used for domestic purposes. The rate of duty is free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
