RE: The tariff classification of a patriotic bow made of plastic strips from China

Dear Mr. To:

In your letter, which was received in our office on September 19, 2007 you requested a tariff classification ruling.

A sample of the product to be classified, a patriotic bow, was submitted. The sample consists of a decorative bow made of red, white and blue polyester (plastic) strips. The strips are approximately 30 mm wide and flocked on one side. Three strips (one each of red, white and blue) are placed side-by-side and sewn together. Three sections of the red, white and blue combination are folded and formed into a 12” wide bow. Attached to the bow are two 20” long streamers composed of three flocked plastic strips in a red, white and red combination. You state that the bow will be distributed by Greenbrier International Inc. especially for the Fourth of July holiday. However, the patriotic red, white and blue bow is not limited for use on this holiday.

The applicable subheading for the patriotic bow made of plastic strips will be 4602.90.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for basketwork, wickerwork and other articles, made directly to shape from plaiting materials or made up from articles of heading 4601; other (than of vegetable materials). The rate of duty will be 3.5 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
