RE: The tariff classification of gun holsters

Dear Mr. Nakachi:

In your letter dated September 14, 2007, on behalf of Soft Air USA, Inc., you requested a classification ruling. The samples which you submitted are being returned.

The samples submitted are identified as a Vertical Shoulder holster, style 60364, and a Horizontal Shoulder holster, style 60362. Both holsters are constructed of a man-made textile material. The holsters are designed to be worn across the back, over the shoulder and under the arm. The items have specially shaped and fitted pouches with hook and loop closures that are designed to provide storage, protection, organization, and portability to a handgun. Each holster has adjustable webbed straps with plastic clips that fasten around the body. The horizontal shoulder holster has an additional pocket with a hook and loop closure and slots for three magazines.

The applicable subheading for the holsters will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTSUS), which provides for trunks, suitcases...gun cases and similar containers, with outer surface of textile materials, other, other, of man-made fibers. The duty rate will be 17.6 percent ad valorem.

HTSUS 4202.92.9026 falls within textile category 670. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
