RE: The tariff classification of a compressed washcloth from China.

Dear Ms. Hobbs:

In your letter dated September 11, 2007 you requested a classification ruling.

The submitted sample, item number 91853, described as a “magic towel” is a compressed washcloth. It is imported compressed in an oval shape. The approximately 12 inch square washcloth is made from 100 percent cotton terry fabric. The fabric is printed with a small chick, eggs and the phrase “Happy Easter. All of the edges are finished with an overlock stitch and it has rounded corners. The oval shaped compressed form of the towel measures approximately 1.75 x 2.25 inches and 1/4 inches in thickness.

The applicable subheading for the washcloth will be 6302.60.0030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for bed linen, table linen, toilet linen and kitchen linen: toilet linen, of terry toweling or similar terry fabrics, of cotton... other. The duty rate will be 9.1 percent ad valorem.

The washcloth falls within textile category designation 369. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
