RE: The tariff classification of mosquito traps from China

Dear Mr. Ige:

In your letter dated September 6, 2007, on behalf of Envirosafe Technologies, you requested a tariff classification ruling. A sample of the mosquito trap was submitted with your ruling request.

The merchandise is identified as the Mega-Catch™ Premier Mosquito Trap, model MCP 800. This model includes a mosquito trap incorporating a programmable timer, a liquid catch container, a standard catch bag, an external skirt, a 110/12 volt transformer, a 60 foot low-voltage extension cord, a mega-catch octenol fragrance strip, a stand and an operation manual. The Mega-Catch™ Premier Mosquito Trap has been designed for indoor or outdoor use. The trap catches mosquitoes, biting midges, black flies and sand flies. It has a self-contained electric motor and a high speed fan inside the trap. The trap features an electronically controlled diode lighting system that produces intermittent light at oscillating frequencies selected to coincide with spectral sensitivity peaks for many mosquito species. It also features a low-intensity U.V. (ultra violet) or black light bulb. Mosquitoes are attracted by the light and they land on and enter the trap where they are collected in the catch bag or liquid catch container. The Mega Catch™ Premier Mosquito Trap weighs approximately 18 lbs./8 kg. It has a maximum range of 120 feet and maximum coverage of 1 acre.

Your sample will be returned as requested.

The applicable subheading for the mosquito traps will be 8509.80.5095, Harmonized Tariff Schedule of the United States (HTSUS), which provides for electromechanical domestic appliances, with self-contained electric motor, other than vacuum cleaners of heading 8508, other appliances, other, other. The rate of duty will be 4.2 percent ad valorem.
