RE: The tariff classification of a tote bag from China

Dear Ms. Cachia:

In your letter dated September 6, 2007, on behalf of Chateau International, you requested a tariff classification ruling. The samples which you submitted are being returned as requested.

Style RD23077 is a tote bag constructed with an outer surface of polyvinyl chloride (PVC) plastic sheeting. The bag is designed to provide storage, protection, portability, and organization to clothing and other personal effects during travel. It features one shoulder strap, one large textile-lined interior storage compartment, two interior pouch pockets, one interior zippered pocket, and an open top with one snap closure. It measures approximately 14” (W) x 16” (H) x 5” (W).

The applicable subheading for the tote bag will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sport, and similar bags, with outer surface of plastic sheeting material, other. The rate of duty will be 17.6% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
