RE: The tariff classification of Epirubicin Hydrochloride Injection in dosage form, from India

Dear Ms. Demkowicz:

In your letter dated September 11, 2007, you requested a tariff classification ruling.

The subject product, Epirubicin Hydrochloride Injection, is an anthracycline antibiotic belonging to a group of chemotherapy drugs. It is used in the treatment of early stage breast cancer and is typically used in combination with other drugs to prevent breast cancer cells from coming back or spreading to other parts of the body.

The applicable subheading for the Epirubicin Hydrochloride Injection in dosage form will be 3004.20.0060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Medicamentsconsisting of mixed or unmixed products for therapeutic or prophylactic uses, put up in measured doses (including those in the form of transdermal administration systems) or in forms or packings for retail sale: Containing other antibiotics: Other: Other." The rate of duty will be free.
