RE: The tariff classification of “Safety Fence Spike Strips” from Taiwan.

Dear Ms. Ramsey:

In your letter dated August 24, 2007, you requested a tariff classification ruling.

A photograph was provided with your letter. The Safety Fence Spike Strips (SKU #53240) are designed to be placed on top of a fence to prevent burglars and other intruders from climbing the fence. There are four strips to a package. Each strip measures 19 ½ inches in length by 2 inches in width, and contains 99 plastic spikes, each spike measuring ¾ inch in height. Mounting hardware is included.

The applicable subheading for the Safety Fence Spike Strips will be 3926.90.9980, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other articles of plastics, other. The rate of duty will be 5.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
