RE: The tariff classification of a belt from China.

Dear Mr. Mauna:

In your letter dated August 26, 2007, on behalf of Triple Accessories, Inc., you requested a classification ruling.

The submitted sample, identified as a “waistband” is a belt made of knit man-made fiber fabric. The elastic girds the waist and is sewn onto man-made fiber fabric coated with polyurethane. The belt is shirred and measures approximately 3” wide with a metal clasp.

 The applicable subheading for the “waistband” belt will be 6117.80.9540, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other made up clothing accessoriesknitted or crocheted:Other accessories: Other: Other, Of man-made fibers." The duty rate will be 14.6% ad valorem. The textile category designation is 659.
