RE: The tariff classification of a girls’ garment from China.

Dear Mr. Armani:

In your letter dated August 23, 2007, you requested a tariff classification ruling. As requested, the sample will be returned to you.

The submitted sample, style CG001 is described by you as a girl’s jacket. The article is not a jacket because it does not offer sufficient protection against the elements. It is similar to a cardigan. The garment is constructed from cotton knit French terry fabric that contains more than 9 stitches per two centimeters measured in the direction in which the stitches are formed. The item features a hood with a leopard print lining, short sleeves with rib-knit cuffs, a full frontal opening with zipper closure, a kangaroo pocket and a rib-knit bottom. The garment reaches the vicinity of the waist.

The applicable subheading for style CG001 will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, waistcoats (vests) and similar articles, knitted or crocheted: of cotton, other, other: other: women’s or girls’: other. The rate of duty will be 16.5 percent ad valorem.

Style CG001 falls within textile category 339. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
