RE: The tariff classification of an air freshener holder from China

Dear Mr. VanRees:

In your undated letter, which was received in this office on August 24, 2007, you requested a tariff classification ruling.

The sample submitted with your request is an air freshener holder identified as item PCH-HLDR-01. It is a sleeve molded of polypropylene plastic material, designed to be affixed to a wall by means of the two strips of mounting tape on the back surface. The holder measures 6 ¼ inches by 2 ½ inches by ½ inch. It is used to hold an air freshener that can be replaced as needed through the opening at the top. The front panel incorporates ten holes to allow the fragrance to dissipate into the room.

The applicable subheading for the air freshener holder will be 3925.90.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for builders’ ware of plastics, not elsewhere specified or included: other. The rate of duty will be 5.3 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
