RE: The tariff classification of two women’s knitted pullovers from China.

Dear Mr. Bartlett:

In your letter dated August 13, 2007 you requested a classification ruling on behalf of your client National Stores Inc. As requested, your samples are being returned to you.

Style number LA221 is a woman’s cut and sewn pullover that is constructed from 92% nylon and 8% elastane knitted fabric. The outer surface of the garment measures more than nine stitches per two centimeters in the direction that the stitches were formed. The garment features a mock-neck collar, short sleeves, a ruffled bottom, and decorative stitching throughout the garment.

Style number LA222 is a woman’s cut and sewn pullover that is also constructed from 92% nylon and 8% elastane knitted fabric. The outer surface of the garment measures more than nine stitches per two centimeters in the direction that the stitches were formed. The garment features a mock-neck collar, ¾ length sleeves, a straight bottom, and decorative stitching throughout the garment.

The applicable subheading for both styles will be 6110.30.3059, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: Other: other: other: other: women’s or girls’. The duty rate will be 32%.

Both styles fall within textile category 639. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries.
