RE: The tariff classification of girl’s pants from China.

Dear Mr. Gomez:

In your letter dated August 2, 2007, on behalf of Far East Connection International Trading, Inc. for J.C. Penney, Inc., you requested a classification ruling. As requested, the sample will be returned to you.

The submitted sample, style 3395403 consists of a legging pant constructed of 95% cotton, 5% spandex knit fabric. The pants feature an enclosed elasticized waist and are trimmed at the ankles with one inch wide lace. Style 3395403/w is the exact same pant, except with a double overlock stitched bottom.

The applicable subheading for styles 3395403 and 3395403/w will be 6104.62.2026, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts, knitted or crocheted: trousers, bib and brace overalls: of cotton: other, trousers and breeches: girls’: other: containing 5 percent or more by weight of elastomeric yarn of rubber thread. The duty rate will be 14.9 percent ad valorem.

Styles 3395403 and 3395403/w fall within textile category 348. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
