RE: The tariff classification of a costume from China.

Dear Mr. Fragomeli:

In your letter dated August 3, 2007, you requested a classification ruling. The sample which you submitted is being returned as requested.

The submitted sample, Sexy Nurse Costume Set will be imported as:

Item 6838638, Size 14, Junior G-Teen
Item 6838639, Size 16, Junior G-Teen
Item 6808049, Size S, Adult Woman
Item 6808051, Size M, Adult Woman
Item 6808052, Size L, Adult Woman

The Sexy Nurse Costume Set consists of a dress and hat made of 100% polyester fabric. The dress is made of woven fabric with the exception of the side midriff and top back. The garment has an attached petticoat, short puffed sleeves, ribbon lace closure at the front and Rochelle knit at the midriff sides. The dress also features an attached apron and a zipper back closure.

The costume is well made with a well made waist, seams, edges, styling and embellishments.

General Rule of Interpretation (GRI) 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale. GRI 3(b) states that the goods “shall be classified as if they consisted of the material or component which gives them their essential character.” In this case, the dress imparts the essential character of the set.

The applicable subheading for the Sexy Nurse Costume Set, Items 6838638 and 6838639, will be 6204.43.4040, Harmonized Tariff schedule of the United States (HTSUS), which provides for "Women’s or girls’dresses(other than swimwear): Dresses: Of synthetic fibers: Other: Other, Other: Girls’". The rate of duty will be 16% ad valorem. The textile category designation is 636.

  The applicable subheading for the Sexy Nurse Costume Set, Items 6808049, 6808051 and 6808052 will be 6204.43.4030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): Dresses: Of synthetic fibers: Other: Other: Other: Women’s." The rate of duty will be 16% ad valorem. The textile category designation is 636.
