RE: The tariff classification of a harness from China

Dear Ms. Garcia:

In your letter dated August 13, 2007, you requested a tariff classification ruling.

The item in question is identified as a harness for the “BackPacVac,” BV100, that is designed to fit over the shoulders and strap around the midsection, much like a backpack. According to the specification sheet, the main cover material is polyester fabric, the straps are made of polypropylene, and the hardware is plastic. The harness contains five eyelets on the main body of the product where, after importation, it will be permanently attached to the vacuum cleaner prior to being put up for retail sale. You state that in its imported condition it is not designed to carry anything else.

The applicable subheading for the harness will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem.
