RE: The tariff classification of a woman’s’ cardigan from China.

Dear Mr. Roberts:

In your letter dated August 7, 2007, you requested a tariff classification ruling. As requested, the sample will be returned to you.

Your submitted sample, Style B1001 is a woman’s cardigan constructed from 80% rayon, 20 % nylon knit fabric. The outer surface of the garment measures between 9 and 18 stitches per two centimeters in the direction in which the stitches are formed. The garment has long sleeves, a deep round neckline and a full front, closely spaced, seven button opening. Style B1001 does not meet the requirements of Statistical Note 6, Chapter 61, Harmonized Tariff Schedule of the United States (HTSUS), because the placket and collar components are not knit to shape. These components do not have a self start bottom.

The applicable subheading for style B1001 will be 6110.30.3059, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers, other, other: other: women’s or girls’: other. The rate of duty will be 32 percent ad valorem.

Style LPGA40007 falls within textile category 639. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
