RE: The tariff classification of a girls’ garment from China.

Dear Mr. Chen:

In your dated, August 6, 2007, you requested a tariff classification ruling. As requested, the sample will be returned to you.

Your submitted sample, style WD36465 is a girl’s cardigan. The cardigan features a hood with adjustable drawstring, long sleeves, a full frontal opening with zipper closure, front patch pockets and a rib-knit bottom. The garment is constructed of two different cotton knit fabrics. The hood, front panels, rib-knit cuffs and rib-knit bottom are constructed of knit fabric with an outer surface measuring less than 9 per two centimeters in the direction in which the stitches are formed. The back panel, sleeves, fabric forming the approximately two inch wide edging around the hood, front plackets and pockets are constructed of French terry fabric with an outer surface measuring between 9 and 18 stitches per two centimeters in the direction in which the stitches are formed. The garment reaches the vicinity of the waist. The essential character is imparted by the French terry knit fabric.

The applicable subheading for style WD36465 will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, waistcoats (vests) and similar articles, knitted or crocheted: of cotton, other, other: other: women’s or girls’: other. The rate of duty will be 16.5 percent ad valorem.

Style WD36465 falls within textile category 339.
