RE: The tariff classification of tights from China

Dear Mr. Nagel:

In your letter dated August 3, 2007, you requested a classification ruling. The submitted sample will be returned.

Style HAS08007 “Women’s Net Tight” is a pair of adult tights constructed of 80% nylon and 20% spandex knitted fabric. The fishnet style footed tights have a gusset crotch and feature a fabric covered elasticized waistband. You state that the tights measure 44 decitex.

The applicable subheading for Style HAS08007 will be 6115.21.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Panty hose, tights, stockings, socks and other hosieryknitted or crocheted: "Other panty hose and tights: Of synthetic fibers, measuring per single yarn less than 67decitex, Tights." The duty rate will be 16 percent ad valorem.

Style HAS08007 falls within textile category 659. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
