RE: The tariff classification of costume pants from China.

Dear Mr. Fragomeli:

In your letter dated August 1, 2007, you requested a classification ruling. The sample will be returned to you.

The submitted sample Pink Champagne Costume Pants will be imported as:

Item 6838369, S (4-6)
Item 6838370 M (8-10)
Item 6838371 L (12-14)

Examination reveals that the item, which you describe as leggings, is a pair of costume pants made of knit 100% polyester fabric. The well made costume pants have a finished elasticized waist, seams and hem.

 The applicable subheading for the Pink Champagne Costume Pants, Item 6838369, 6838370 and 6838371, Costume Pants will be 6104.63.2028, Harmonized tariff Schedule of the United States (HTS), which provides for "Women’s or girls’trousersTrousersOf synthetic fibers: Other: Other, Trousers and breeches: Girls’: Other: Other." The duty rate will be 28.2% ad valorem. The textile category designation is 648.
