RE: The tariff classification of a pair of women’s and girls’ shorts from Mexico.

Dear Ms. Shu:

In your letter dated July 25, 2007, you requested a tariff classification ruling. The submitted sample, Style #742, is a pair of women’s shorts constructed from 90% polyester and 10% spandex knit fabric. The shorts feature an elasticized waistband and hemmed leg openings. You state that the garment will also be imported in girls’ sizes S-L under Style #743.

We are returning your sample as you requested.

The applicable subheading for the women’s shorts, Style 742 will be 6104.63.2030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ trousers, bib and brace overalls, breeches and shorts (other than swimwear), trousers bib and brace overalls, breeches and shorts, of synthetic fibers, other, other, Shorts: Women’s. The rate of duty will be 28.2% ad valorem.

The applicable subheading for the girls’ shorts, Style 743 will be 6104.63.2060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ trousers, bib and brace overalls, breeches and shorts (other than swimwear), trousers bib and brace overalls, breeches and shorts, of synthetic fibers, other, other, Shorts: Girls’:Other. The rate of duty will be 28.2% ad valorem.

The shorts, Styles 742 and 743, fall within textile category 648. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
