RE: The tariff classification of a woman’s jacket from Vietnam

Dear Ms. Whitley:

In your letter dated July 31, 2007, you requested a classification ruling. Your sample will be returned as requested.

Submitted sample, style #C4620S8, is a woman’s jacket constructed from 70% cotton and 30% nylon woven fabric. The garment features a drawstring hood, long sleeves with snap closures, a full front zippered opening, two pockets at the waist and a drawstring bottom.

The applicable subheading for the style C4620S8 will be 6211.42.0075, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of cotton: jackets and jacket-type garments excluded from heading 6202. The duty rate will be 8.1 percent ad valorem.

Style C4620S8 falls within textile category 335.
