RE: The tariff classification of eyeglass cloth with a pouch from China

Dear Ms. Davidson:

In your letter dated July 20, 2007 you requested a classification ruling.

The submitted sample, SKU# 10026793, is an eyeglass cloth stored in a pouch. The microfiber cloth is made from polyester and nylon knit fabric. All of the edges are pinked. The cloth measures approximately 5.25 x 6.25 inches. The plastic pouch features a split key ring. It measures 2.25 inches in diameter and is sized to fit the folded cloth. The pouch and cloth are considered to be a composite good. The essential character is imparted by the eyeglass cloth.

The applicable subheading for the eyeglass cloth with the pouch will be 6307.10.2030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up articles, including dress patterns: floorcloths, dishcloths, dusters and similar cleaning cloths: other other. The duty rate will be 5.3 percent ad valorem.

The above subheading is not assigned a textile category designation.
