RE: The tariff classification of a hood from China.

Dear Ms. Hartman:

In your letter dated July 23, 2007, you requested a classification ruling.

The pictures you submitted are identified as Fetish hoods made of knit 100% spandex fabric. The items resemble a balaclava in that they cover the face and head.

Style STR1001 – Fetish Hood is used to completely block vision and cover the entire the head. Item is sewn from two panels with foam lining added to the eye area to block out light.

Style STR1002 – Fetish Hood is used to completely cover the head with the exception of the mouth area and block out vision.

Style STR1003 – Fetish Hood is made from two panels with openings in the eye, mouth and nose areas.

   The applicable subheading for Fetish Hoods, Styles STR1001, STR1002 and STR1003 will be 6505.90.6090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabricOther: Of man-made fibers: Knitted or crocheted or made up from knitted or crocheted fabric: Not in part of braid, Other: Other: Other." The duty rate will be 20 cents per kilogram plus 7% ad valorem. The textile category designation is 659.
