RE: The tariff classification of a bird feeder pole and a squirrel baffle from China

Dear Mr. Cuddy:

In your letter dated July 23, 2007, on behalf of Chapin Mfg., you requested a tariff classification ruling.

The merchandise is a steel pole that holds a bird feeder and a steel squirrel baffle. The bird feeder pole comes with a ground socket to make installation easy. The pole is polyester powder-coated to provide protection from the elements. The squirrel baffle is placed on a pole holding a bird feeder. The squirrel baffle is used to keep squirrels from reaching the birdseed.

The applicable subheading for the bird feeder pole and squirrel baffle will be 7323.99.9060, Harmonized Tariff Schedule of the United States (HTSUS), which provides for table, kitchen or other household articles and parts thereof, of iron or steel, other, other, not coated or plated with precious metal, other, other, other. The rate of duty will be 3.4 percent ad valorem.
