RE: The tariff classification of an iPod case from China

Dear Ms. Collins:

In your letter dated July 11, 2007, you requested a classification ruling. The sample which you submitted is being returned as requested.

The sample is identified as an iPod case, style number CS1531456C. It is constructed of 100% wool textile fiber. The item is a small handheld carrying case specially fitted, shaped and designed to provide storage, protection, and portability to an iPod device. It is knitted in the shape of a rat and has a tail that acts as a drawstring closure. It measures approximately 2.25” (W) x 6.25” (L).

The applicable subheading for the iPod case will be 4202.92.9036, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for other containers and cases, of textile materials, other, other. The duty rate will be 17.6 percent ad valorem.

HTSUS 4202.92.9036 falls within textile category 870. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
