RE: The tariff classification of a flimsy costume from China.

Dear Mr. Fragomeli:

In your letter dated July 13, 2007, you requested a tariff classification ruling.

You submitted the following costume, which meets the flimsy requirements for classification within Chapter 95 and is being returned upon your request.

Style numbers (6838224-226, Child Girl; 6838632-633, Teen Girl; 6808039, 6808041, 6808042, Adult Woman; 6848010, 6848011, Plus Size), Queen of the Vampires, are ten styles of a textile costume set that consists of a dress, an overskirt, a headpiece and a collar, with the dress imparting the essential character. Although the dress has a styling feature and a well-made embellishment, it has it has a flimsy and loose visible overlock stitched neck, a flimsy and loose single stitched waist, flimsy thin elastics at the arms, a flimsy hook and loop tab closure and flimsy edges at the bottom and closure.

The applicable subheading for style numbers (6838224-226, Child Girl; 6838632-633, Teen Girl; 6808039, 6808041, 6808042, Adult Woman; 6848010, 6848011, Plus Size), Queen of the Vampires, will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HSTUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be Free.
