RE: The tariff classification of a women’s pullover from China.

Dear Ms. Baron:

In your letter dated July 17, 2007, on behalf of your client E.M. Lawrence, Ltd., you requested a tariff classification ruling. As requested, the sample will be returned to you.

Your submitted sample, style FGL37907 is a women’s long sleeve turtleneck pullover constructed from 100% cotton 2 by 2 rib knit fabric. The outer surface of the garment measures between nine stitches per two centimeters and 18 stitches per two centimeters in the direction the stitches are formed. The garment is knit to shape on a flat knitting machine and assembled by looping and linking. The pullover meets the requirements of Statistical Note 6, Chapter 61, Harmonized Tariff Schedule of the United States (HTSUS).

The applicable subheading for style FGL37907 will be 6110.20.2077, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, waistcoats (vests) and similar articles, knitted or crocheted: of cotton, other, other: other: women’s or girls’: knit to shape articles described in statistical note 6 to this chapter. The rate of duty will be 16.5 percent ad valorem.

Style FGL37907 falls within textile category 339.
