RE: The tariff classification of a costume from China.

Dear Mr. Fragomeli:

In your letter dated July 12, 2007, you requested a classification ruling. The sample will be returned to you as requested.

The submitted sample, Spring Witch Costume Set will be imported as:

Items 6838646, 6838647 –Teen, Sizes14-16 Items 6808100, 6808101, 6808102 – Adult W, Sizes S, M, L Items 6848014, 6848015 – Plus Size, 1X, 2X

The Spring Witch Costume Set consists of a dress and witch hat made of woven 100% woven polyester fabric. The dress has a skirt and sleeves with an overlay of net fabric, mutton-style sleeves, a scoop neckline, fabric roses for decoration and a back opening with hook and loop closures.

The costume is well made with styling, embellishments and multi-layered dress.

General Rule of Interpretation (GRI) 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale. GRI 3(b) states that the goods “shall be classified as if they consisted of the material or component which gives them their essential character.” In this case, the dress imparts the essential character of the set.

The applicable subheading for the Spring Witch Costume Set, Items 6838646, 6838647 - Teen will be 6204.43.4040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for provides for “ Women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirtsDresses: Of synthetic fibers: Other: Other, Other: Girls’.” The duty rate will be 16 percent ad valorem. The textile category is 636.

   The applicable subheading for the Spring Witch Costume Sets, Items 6808100, 6808101, 6808102 – Adult W, 6848014, 6848015 – Plus Size will be 6204.43.4030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts (other than swimwear): Dresses: Of synthetic fibers: Other: Other: Other: Women’s." The rate of duty will be 16% ad valorem. The textile category designation is 636.
