RE: The tariff classification of a men’s knit shirt from India.

Dear Ms. Iacobello:

In your letter dated July 10, 2007, you requested a tariff classification ruling. As requested, your samples will be returned.

Izod Style 4559045 is a men’s shirt constructed from 80% cotton, 20% polyester, finely knit fabric that is napped on the inside surface. The fabric measures 10 stitches per linear centimeter counted in the horizontal direction and 12 stitches per linear centimeter counted in the vertical direction. The shirt has a self-fabric stand up collar with two button closures; a partial front opening with a left-over-right, two button closure; an embroidered logo on the left chest; long sleeves with rib knit cuffs; a woven fabric label sewn in the left side seam; and a straight, hemmed bottom with side slits.

The applicable subheading for Izod Style 4559045 will be 6105.10.0010, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: men’s or boys’ shirts, knitted or crocheted: of cotton: men’s. The duty rate is 19.7% ad valorem.

Izod Style 4559045 falls within textile category designation 338. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
