RE: The tariff classification of handbags from China

Dear Ms. Shanteau:

In your letter dated July 12, 2007, you requested a classification ruling on behalf of Dolgencorp Inc. Your samples are being returned to you.

The submitted samples are identified as styles SS0705022 and SS0705021. They are children’s novelty handbags constructed of 100% polyester textile material. Each bag measures approximately 8” (W) x 7.5” (H) x .25” (D). Each features one main storage compartment and two carry handles. They are designed and sized to contain the small personal effects a child would carry daily. The handbags provide the useful functions of storage, protection, organization and portability. Each handbag is embroidered with either a rabbit or heart design.

The applicable subheading for the handbags will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for handbags, whether or not with shoulder strap, including those without handles, with outer surface of textile material, other, other, other, of man-made fibers. The duty rate will be 17.6% ad valorem.

HTSUS 4202.22.8050 falls within textile category 670. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
