RE: The tariff classification of lasers pet toy from China.

Dear Ms. Marlowe:

In your letter dated July 10, 2007, on behalf of MiracleBeam Products, you requested a tariff classification ruling. A sample was submitted with your ruling request.

The laser pet toy, item number 2041, consists of a laser diode contained in a 2 ½ inch long cylindrical brass outer case, with on-off button, and two batteries. The laser pet pod’s operating voltage is 4.5V and it uses 2 LR44 button batteries. The case is attached to a 1 inch chain with a ring, a swivel link and a snap hook. The item is principally marketed for the entertainment of dogs, cats, birds, fish and reptiles. The laser toy emits a bright red dot and entertains pets when the red dot is shown and moved in front of the animal. The pets chase the laser beam as if it were a ball or stuffed animal.

The applicable subheading for the laser pet toy will be 9013.20.0000 Harmonized Tariff Schedule of the United States (HTSUS), which provides for lasers, other than laser diodes.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
