RE: The tariff classification of travel bags from China

Dear Ms. Ramsey:

In your letter dated July 11, 2007, you requested a tariff classification ruling. Your samples are being returned.

The sample submitted is identified as styles 59300/Gold and 59302/Silver. The items are sets of travel bags constructed with an outer surface of polyvinyl chloride (PVC) plastic sheeting material. Both styles consist of five bags ranging in size from approximately 4 inches by 3 inches to approximately 8.5 inches by 6 inches. Each bag has one textile-lined compartment with a top zipper closure. The bags comprising each set are nested one inside the other, so that the smaller bag fits within the next larger sized bag. As the bags are packaged nested one inside the other, it is the largest bag which is visible to the consumer at the point of sale. The largest travel bag provides the essential character to each set.

The applicable subheading for the travel bags will be 4202.92.4500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sports, and similar bagsother. The duty rate will be 20% ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
