RE: The tariff classification of girl’s knitwear from Macau.

Dear Mr. Hoffacker:

In your letter dated July 6, 2007, on behalf of Sugartown Worldwide, Inc., you requested a tariff classification ruling. As requested, the sample will be returned to you.

Style 66738G is described as a “Girl’s Long Sleeve Cryi Crew Novelty Tee.” It is a girl’s pullover made of finely knit cotton fabric. The item has a round neck, long hemmed sleeves, a hemmed bottom and appliqué work on the front panel. The article is not a tariff heading 6109 tee shirt because of the long sleeves and front panel textile decorations. The item is a girls’ size 5.

The applicable subheading for Style 66738G will be 6110.20.2079, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for sweaters, pullovers and similar articles, knitted or crocheted: of cotton, other, other, women’s or girls’: other. The duty rate will be 16.5% ad valorem.
