RE: The tariff classification of a woman’s pullover from China.

Dear Mr. Hoffacker:

In your letter dated July 6, 2007, on behalf of Sugartown Worldwide Inc., 800 Third Avenue, King of Prussia, PA 19406, you requested a classification ruling. Your sample is being returned as requested.

The submitted sample, style 66702, is a woman’s pullover with a beaded necklace that is permanently attached at the neckline. The garment is constructed from 80% wool, 20% cashmere wool knit fabric. The outer surface of the fabric measures more than 9 stitches per 2 centimeters in the direction that the stitches were formed. The garment features a ribbed neckline, short sleeves with ribbed cuffs, a one button partial opening on the upper back, and a ribbed bottom. Ribbons are attached to the necklace.

The pullover and necklace are considered as a composite good. The essential character is given by the pullover; Harmonized Tariff Schedule of the United States (HTSUS), General Rules of Interpretation (GRI), Rule 3, noted.

The applicable subheading for the pullover will be 6110.11.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for pullovers, knitted: of wool or fine animal hair: of wool: other: women’s. The duty rate will be 16% ad valorem.

The pullover falls within textile category 438. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
