RE: The tariff classification of a wall hanging from India

Dear Mr. Shukla:

In your letter dated July 10, 2007 you requested a classification ruling.

You submitted a sample and pictures of a wall hanging (catalogue number 7). The wall hanging is made from a woven fabric that is stated to be jute. The face of the wall hanging is appliquéd with a depiction of “Mickey Mouse” and balloons. The top of portion of the wall hanging has a loop used to hang the item from a wall. The bottom features a fringe.

The applicable subheading for the wall hanging will be 6304.99.2500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other furnishing articles, excluding those of heading 9404: other: not knitted or crocheted, of other textile materials: other: of vegetable fibers: wall hangings of jute. The duty rate will be 11.3 percent ad valorem.

Subheading 6304.99.2500, HTSUS is not assigned a category designation. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. For current information regarding possible textile safeguard actions on goods from China and related issues, we refer you to the web site of the Office of Textiles and Apparel of the Department of Commerce at otexa.ita.doc.gov.

Please note, that importations of this wall hanging might be subject to the provisions of Section 133 of the Customs Regulations if they copy or simulate a registered trademark, trade name or copyright recorded with the United States Customs Service. If you are an authorized importer of the product we recommend notifying your local Customs office prior to importation.  If not, it is required that you obtain written permission from the trademark and copyright owner before importing the wall hanging with the “Mickey Mouse” figure. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
