RE: The tariff classification of a woman’s cardigan from China.

Dear Mr. Ryu:

In your letter dated July 6 2007 you requested a classification ruling. As requested, your sample is being returned to you.

The submitted sample, style 7323-1570, is a woman’s cardigan that is constructed from 80% cotton and 20% polyester knit fabric. The outer surface of the fabric measures more than nine stitches per two centimeters in the direction that the stitches were formed. The garment extends to below the waist. The cardigan features a drawstring hood, long sleeves with loose fitting ribbed cuffs, a full front zippered opening, a South Pole embroidery appliqué is found on the lower left front panel, and a loose fitting ribbed bottom.

Style 7323-1570 lacks tightening at the garment bottom and cuffs, therefore, it is properly classified as a cardigan under 6110, HTSUS.

The applicable subheading for the cardigan will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweatersand similar articles, knitted: of cotton: otherother: women’s. The duty rate will be 16.5% ad valorem.

The cardigan falls within textile category 339. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
