RE: The tariff classification of a woman’s cardigan from Hong Kong.

Dear Ms. Fox:

In your letter dated June 26, 2007, on behalf of Jones Apparel Group, you requested a classification ruling. Your sample is being returned as requested.

The submitted sample, style 21BU39906, is a woman’s cardigan that is constructed from 69% polyester, 26% rayon, 5% spandex knit fabric. The outer surface of the fabric measures more than 9 stitches per 2 centimeters in the direction that the stitches were formed. The garment features a beaded half moon neckline, ¾ length pieced raglan hemmed sleeves, a full front opening with a 5 button closure, and a hemmed bottom.

The applicable subheading for the cardigan will be 6110.30.3059, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweatersand similar articles, knitted: of man made fibers: otherother: women’s. The duty rate will be 32% ad valorem.

The cardigan falls within textile category 639. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
