RE: The tariff classification of Semi Sweet Chocolate Chips from Canada

Dear Ms. Comeau:

In your letter dated June 28, 2007 you requested a tariff classification ruling.

Item number 0708340-050 is described as Semi Sweet Chocolate Chips. It is stated to contain 49.88 percent cocoa paste, 45.685 percent sugar, 4.029 percent dextrose, 0.3 percent soya lecithin, 0.071 percent cocoa butter, and 0.03 percent vanilla extract. It will be imported in packaging weighing 50 pounds and is intended for use in baking.

The applicable subheading for the Semi Sweet Chocolate Chips will be 1806.20.5000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for chocolate and other food preparations containing cocoa...other preparations in blocks, slabs or bars, weighing more than 2 kg or in liquid, paste, powder, granular or other bulk form in containers or immediate packing, of a content exceeding 2 kg: Preparations consisting wholly of ground cocoa beans, with or without added cocoa fat, flavoring or emulsifying agents, and containing not more than 32 percent by weight of butterfat or other milk solids and not more than 60 percent by weight of sugar: Other: Other. The general rate of duty will be 4.3 percent ad valorem.
