RE: The tariff classification of an automobile trunk liner from Germany

Dear Ms. Waits:

In your letter dated May 18, 2007, received by this office on June 26, 2007 you requested a classification ruling on behalf of Duramotive Gmbh.

The instant samples are trunk liners. They are made from 100 percent polyamide yarns that are tufted into a needle felt base fabric. The trunk liner is cut to size and shape and will be used to cover the floor and sides of the trunk of a car.

The applicable subheading for the trunk liner will be 5703.20.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for carpets and other textile floor coverings, tufted, whether or not made up: of nylon or other polyamides: hand-hooked, that is, in which the tufts were inserted by hand or by means of a hand tool. The duty rate will be 5.8 percent ad valorem.

The trunk liner falls within textile category 666. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
