RE: The tariff classification of a polishing cloth from Hong Kong

Dear Mr. Birdwell:

In your letter dated June 21, 2007 you requested a classification ruling.  You will be importing a polishing cloth. Pictures of the cloth were submitted with your request. The cloth is made from a napped 100 percent cotton woven fabric. The fabric is impregnated with a special cleaner and anti-tarnish agent. It measures 10 x 14 centimeters and all of the edges are pinked. The cloth is designed to polish jewelry.

     The applicable subheading for the cloth will be 6307.10.1090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up articles: floorcloths, dishcloths, dusters and similar cleaning cloths: dustcloths, mop cloths and polishing cloths, of cotton... other. The duty rate will be 4.1 percent ad valorem.

The polishing cloth falls within textile category 369. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
