RE: The tariff classification of a woman’s knit garment from China

Dear Mr. Maher:

In your letter dated June 19, 2007, you requested a tariff classification ruling on behalf of Eileen Fisher. The provided sample is being returned as per your request.

Style F7-WJ-T1091M-3 is a woman’s cut and sewn long sleeve pullover made of 100% wool knit fabric whose outer surface measures more than 9 stitches per 2 centimeters in the direction in which the stitches are formed. The garment features long sleeves, a scooped neckline and a hemmed bottom.

The applicable subheading for style F7-WJ-T1091M-3 will be 6110.11.0080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of wool or fine animal hair: other: Women’s or girls’. The rate of duty will be 16%.

Style number F7-WJ-T1091M-3 falls within textile category 438. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
