RE: The tariff classification of a digital photo/video display unit from China.

Dear Ms. Kim:

In your letter dated June 19, 2007, you requested a tariff classification ruling.

The subject merchandise, based on the submitted information, is a digital photo/video display unit, which is referred to as the “TFT-LCD AD Display,” that incorporates a 17-inch diagonal-color screen with a resolution of 1280x1024 pixels. This device, which does not incorporate a tuner, but has NTSC/PAL video signal compatibility, can accommodate the insertion of several media cards, e.g., a compact flash card or a secure digital card, to reproduce photos and videos, as well as play music in noting that media files can be downloaded to a new card through a PC. It is stated that this merchandise, at the time of importation, will be retail packed with an AC power cable, a key for securing the media card within the device, a remote control, and an operation guide. This merchandise will be considered a set for tariff classification purposes with the essential character being imparted by the display unit.

The applicable subheading for this TFT-LCD AD Display will be 8528.59.2000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Monitors and projectors, not incorporating television reception apparatusOther monitors: Other: Color: With a flat panel screen: Incorporating video recording or reproducing apparatus: Other. The rate of duty will be 3.9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
