RE: The tariff classification of a girl’s dress from China or Malaysia.

Dear Ms. King:

In your letter dated June 13, 2007, on behalf of Oshkosh B’ Gosh Inc., you requested a classification ruling. As requested, the sample will be returned to you.

The submitted sample, style X9027 is a girl’s toddler sized (2T-4T) dress constructed from 100% cotton terry knit fabric. The dress features a hood, short capped elasticized sleeves, an elasticized waist, a frontal opening above the waist secured by a three button closure, a kangaroo front skirt pocket and a hemmed bottom.

The applicable subheading for style X9027 will be 6104.42.0020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, skirts, divided skirts, trousers, bib and brace overalls, breeches and shorts, knitted or crocheted: dresses: of cotton, girls’. The duty rate will be 11.5 percent ad valorem.

Style X9027 falls within textile category 336. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
