RE: The tariff classification of a men’s knit shirt from Cambodia.

Dear Ms. Shu:

In your letter dated June 11, 2007, you requested a tariff classification ruling. As requested, your sample will be returned.

Style 2444 “Pinnacle Dry-Exel Bi-Color Micro-Pique LNG SLV Polo” is a men’s shirt constructed from 100% polyester, finely knit fabric that measures 17 stitches per linear centimeter counted in the horizontal direction and 23 stitches per linear centimeter counted in the vertical direction. Style 2444 features a rib knit spread collar; a partial front opening with three button closures; long sleeves with rib knit cuffs; a rear yoke; piping in the yoke seams and along the sleeves; and a straight, hemmed bottom with side slits. Style 2444 will be imported in Men’s sizes S - 4XL.

The applicable subheading for Style 2444 will be 6105.20.2010, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: men’s or boys’ shirts, of man-made fibers: other: men’s. The duty rate is 32% ad valorem.

Style 2444 falls within textile category designation 638. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
